-Monday, February 20, 2012: City Hall is closed for Presidents Day

-Tuesday, February 21: BOC Work Session. Tentatively, the BOC will hold a Town Meeting at 5;30 p.m., with the Work Session to follow at 6:30 p.m. This will include the Public Hearings on any First Reading on any Ordinances approved by the BOC at the February 2 meeting.

-Thursday, February 23, 2012: The Municipal Planning Commission meeting, normally scheduled for Monday, February 20, was rescheduled to Thursday, February 23, 2012.

-Tuesday, February 28, 2012: The Economic Development Commission meeting normally scheduled on Thursday, February 23 is rescheduled to Tuesday, February 28, 2012.

Transition Planning Commission "Listening Tour" Monday, January 30 in Arlington

The Shelby County Transition Planning Commission "Listening Tour" is scheduled for 7:00 p.m. to 9:00 p.m., Monday, January 30, 2012 at the Arlington High School Auditorium. No Lakeland site visit has been scheduled.

The Commission's "Listening Tour" purpose is to hear comments from the community regarding the Shelby County Schools including the former Memphis City Schools after the Memphis City Schools abandoned their Charter.

Since no Lakeland site visit is planned, this is Lakeland residents' best opportunity to comment to the Transition Planning Committee.

Lakeland Senior Center nears completion, parking lot paved!

The Lakeland Senior Center is nearing completion, including the paving of the IH Clubhouse/Lakeland Senior Center parking lot!

The Senior Center is expected to be finished in January. Furniture etc. will be purchased with donations made to the Senior Center either at the Lakeland Trustmark Bank or the Lakeland Supplemental Income program.

The IH Clubhouse renovation is expected to start in February. An estimated completion date is not available.

A Grand Opening to include both the Lakeland Senior Center and IH Clubhouse is being planned after the renovations are complete.

Donations are still being accepted either at the Lakeland Trustmark Bank or by donating to the Lakeland Supplemental Income program (click here for form).

Donations may be tax deduction for tax year 2011 is made today!

Transportation Report available

The Tennessee Advisory Commission on Intergovernmental Relations (TACIR) staff has published a new staff report, Getting There: Increasing Access to Destinations, which is the final in a four-part series on transportation and land use planning in Tennessee.

The report addresses the potential for accessibility-based land use and transportation planning to assist the state and its local governments in maximizing public investments, enhancing economic development, improving job accessibility, reducing transportation costs, and improving access to transportation for disadvantaged populations.

Accessibility-based planning focuses on making it easier to get from location to location, while traditional mobility-based planning focuses on the trip itself. It considers issues such as density, mixed land uses, connection of road networks, transportation options, and integrated transportation modes.

Lakeland population is 12,430

Lakeland's population, according to the 2010 Federal Census was 12,430 in 2010. Based on housing permits, the actual population is an estimated 13,000.

The Lakeland population was unfortunately incorrectly stated in a December 14, 2012 story in the Commercial Appeal. Errors happen, and we understand that, but figures in a respected newspaper are frequently accepted as fact and the correction isn't seen by many readers.

Also, while it is correct that the City of Lakeland depends on Shelby County for emergency services, Lakeland residents and businesses do pay the normal "fire fees" for the excellent service provided by the Shelby County Fire Department. Lakeland residents also pay Shelby County property taxes which support the outstanding service provided by the Shelby County Sheriff Department.

Lakeland Supplemental Revenue Program Form and Information

Lakeland residents and businesses can support their favorite project(s) by donating for furnishings for the Senior Center, City Beautification (entrance treatments, landscaping, litter control, street sweeping), park development, youth programs and emergency management.

Each donation is segregated into a “restricted” fund so that money donated is used only for that specific project. Any amount of donation is acceptable and will be acknowledged immediately.

A letter was recently sent to all residents advising of the program with a form for submitting a donation or a form can be downloaded here.

Donated funds will enhance services, not substitute for already budgeted items.

A local survey by Commissioner Gerrit Verschuur indicated that it is not only more convenient to shop at our La keland Walgreens at Highway 64 and Canada Road but you can also save money! Dr. Verschuur found that 28 of 43 common items (milk, eggs, beer, paper towels, juice, soft drinks, soups, peanut butter, shampoos and toothpaste) were cheaper at Walgreens than at a Memphis grocery store! And that doesn't even include the savings you can find in the famous Walgreens Sunday Ads!

Although I can't endorse private business, Lakeland residents can take advantage of many local Lakeland businesses that offer excellent service, products and savings. What I appreciate most is the convenience of being able to shop in Lakeland and I appreciate the excellent service and reasonable cost of Lakeland businesses.

Watch for information about local businesses and make an effort to use Lakeland businesses. If you do, you know what I mean, if you don't you will be pleasantly surprised!

Flowers by Regis (in the Lakeland Corners shopping center at Highway 64 and Canada Road, next to ATC Fitness and Little Caesars Pizza, is another alternative to the grocery store which recently moved across the street to Memphis. I believe this leave Flowers by Regis as the only Lakeland flower shop. (The web site is www.FlowersbyRegis.net, not.com. Flowers by Regis is also on Facebook.

Watch for the upcoming listing of Lakeland businesses and plan to make support of Lakeland businesses a priority!

I-40 and Canada Road Interchange Design Publie Meeting Tuesday, October 11

IH Clubhouse renovation scheduled

The Lakeland Board of Commissioners recently approved an architectural contract for plans for renovation of the IH Clubhouse at 4523 Canada Road. Plans are for bathrooms, kitchen, plumbing and interior to be upgraded as well as other improvements such as converting the heating and cooling to natural gas, replacing the septic system and other improvements.

The IH Clubhouse will be closed from at least January 1 through Spring of 2012 for completion of the renovations.

The project is funded 50% by a grant from the Tennessee Local Parks and Recreation Fund.

Lakeland Senior Center walls going up!

Construction of the Lakeland Senior Center has proceeded to the point of the walls going up! The Lakeland Senior Center is funded by a Community Development Block Grant and the City of Lakeland.

The project also includes paving, landscaping and other parking improvements. The project is expected to be completed in early 2012.

Lakeland City Hall welcomes the return of Lakeland Artist Bobbi Cornett for the fourth quarter "Art in City Hall" art.

The art show features some favorites (at least of City Hall personnel and I!) and some art that may become favorites.

The public is welcome to view the art show any time City Hall is open. Normal City Hall hours are 8:00 a.m. to 4:30 p.m. and the art may also be viewed when City Hall is open for evening meetings.

Lakeland Fire Location Study

The Lakeland Board of Commissioners recently requested a Fire Location Study to determine where future fire stations should be located in the City of Lakeland.

The study was recently completed and submitted to the Board of Commissioners. The study was completed by Dennis Wolf, the Fire Consultant for the Municipal Technical Advisory Service (MTAS). We were fortunate that Mr. Wolf completed a very professional, detailed study that will help guide the Board of Commissioners in the future.

October 5, 2011: Beverle Revira extension plans presented with I-40 interchange plans

The planned exhibit of the Canada Road and I-40 interchange replacement plans will include plans for the route for the extension of Beverle Rivera Drive to Seed Tick Road.

This will provide residents and interested persons to review the full impact of the project. Part of the Beverle Rivera Drive extension project is planned as part of the interchange replacement. The City of Lakeland is funding the remainder of the extension to complete the extension.

The project will include a traffic signal at Davies Plantation and Canada Road.

This project will substantially improve traffic flow and fire and sheriff response to the Lakeland Elementary school and the areas along Seed Tick.

Please be careful and give the benefit of the doubt (right of way) to other drivers! There is always some confusion when a new signal is operational.

FUTURE OF PUBLIC EDUCATION IN LAKELAND

Quality public education for Lakeland children is a very important goal for the Lakeland Mayor and Commissioners, Lakeland residents and the future of the Lakeland commuity.

Now that the plan for the Shelby County School Board and an apparent time schedule is known, the Board of Commissioners has information to review possible alternatives for education in Lakeland, including reviewing all possible scenarios with the goal of making the best possible and practicable decision within Tennessee Law and considering financial considerations.

While there is still uncertainty, the Board of Commissioners will review possible alternatives and discuss the situation and how the City of Lakeland should proceed..

The Board of Commissioners appreciates the participation, comments and suggestions of Lakeland residents on this matter as the Board reviews possible alternatives and actions. The Mayor and Commissioners are well aware of the importance of education for residents and your comments, suggestions and participation are important.

All agendas and agenda information are posted on the City web pages www.CityofLakeland.com and www.Lakelandtn.gov so residents can review the information. Due to the interest in the school matter, we will post notices on the Blogs, Twitter accounts, Qnet and Facebook accounts when information is available.

The next discussion by the Lakeland Board of Commissioners on possible action on the public school matter is expected to be the 6:30 p.m., Tuesday, September 27, 2011 Work Session. The Agenda for this meeting will be posted on or about Friday, September 23, 2011. Residents are welcome to attend all City of Lakeland meetings.

LAKELAND KROGER CLOSING TO IMPACT CITY REVENUES AND SERVICES

The closing of the Lakeland Kroger store on Highway 64 will have a major impact on the financial revenue of the City of Lakeland and thus significantly impact projects and services. There will also be on impact on the Lakeland community by not having a “Lakeland” grocery store, at least for a period of time.

We estimate that the closing of the Lakeland Kroger store will have about the same impact as the closing of the major businesses in the Lakeland Mall, which was a very significant reduction in City of Lakeland revenues and thus city programs and services. The Kroger impact will be more sudden than the mall closing (the City of Lakeland revenues will be impacted in December or January if the apparent Kroger schedule is followed.)

The City receives sales tax and Business Use Taxes from the Kroger Lakeland store. Individual taxes paid by a business is confidential.

The Lakeland Board of Commissioners has been setting priorities, and reviewing projects in anticipation of lower revenues based on the the economy and the effects of major businesses closing in the Lakeland Mall.

Projects and services have been delayed or eliminated, City personnel costs and personnel have been reduced and expenses have been minimized as revenues have continued to decrease for the past few years. The decreased revenues from Kroger closing the Lakeland store will be included in the process of setting priorities and having to delay or eliminate projects and services and minimize expenses.

On the positive side, a story in a Memphis business newspaper noted that the Lakeland Mall owner is planning to rebuild the Lakeland Mall and tenant recruitment is in process. When completely developed, the positive financial impact would more than offset the Kroger closing. The story stated the mall would open next year although it probably could take several years for the Lakeland Mall to become fully operational. This will be a significant positive impact on the City sales tax revenues and business in Lakeland.

Another positive note is the Stonebridge Golf Course recent improvements to the greens and other areas, which we expect will substantially increase business for the Golf Course and result in more sales tax and business use tax for the City. The Stonebridge Golf Course just re-opened Thursday, September 1, 2011 and I understand the course is now one of the more outstanding courses in the Memphis area with the new improvements!

The Lakeland Economic Development Commission has been actively developing a strategic plan to recruit quality commercial businesses to Lakeland. Growth Management Director J. HIgbee is working with the EDC to develop the plan which I expect will be instrumental in attracting quality commercial businesses to Lakeland.

Hopefully, the current Lakeland Kroger building will be actively marketed for a suitable commercial business or businesses.

When I first came to Lakeland, a financial analysis indicated that three of the major potential problems for the City of Lakeland included the closing of the Lakeland Mall, and the closing of the Kroger Store (due to their significant sales tax revenue) and the decrease in development. I was even advised the there was no way that Schmucks was going to survive against Walmart and Kroger and that Kroger would get the store across the street cheap when Schmucks withdrew from the Memphis market. All of these threats have become reality, but I feel optimistic that the current initiatives will improve the Lakeland economy in the future. As a friend said, this is “just another opportunity to excel”.

Shelby County Commission proposed Shelby County School Districts

The Shelby County Commission recently proposed Districts for the Shelby County Schools. The Resolution proposing these districts is available at www.CityofLakeland.com

The Shelby County Commission proposal, according to reviews, would result in a Shelby County School Board with five Memphis and two non-Memphis School Board members.

Mosquitoes? Call 324-5547!

Lakeland residents with mosquito problems should call 324-5547 during regular business hours and ask for an Inspector to review possible sources of mosquitos. This is Vector Control (Vector Control means controlling pests such as mosquitos, rats etc) for the Shelby County Health Department and they will send an Inspector.

(Shelby County Vector Control Web Site is http://www.shelbycountytn.gov/index.aspx?NID=774). This has all contact information and a wealth of information about mosquito control.

After receiving a complaint about Mosquitoes and Mosquito control in Lakeland, I discussed this with Dr. Springer, who is in charge of the Shelby County Health Department. It was a very interesting conversation and Dr. Springer obviously is dedicated and I learned a lot about mosquitos in Shelby County.

Some items of interest to Lakeland residents are:

-There is a Vector Control crew working on the mosquito (and other pest) problems full time from March through October each year in the Lakeland/Arlington area. They treat sources of mosquitos and respond to complaints.

The primary method of controlling mosquitos is through eliminating or treating to kill mosquitos in stagnant water. Stagnant water is THE source of mosquitos.

-Lakeland has not been treated for mosquitos by the traditional truck spraying into the air this year. The reason for this is that the type of mosquito currently in Lakeland (I won't try to spell it) doesn't carry West Nile Virus and is not controlled by air spray.

-The West Nile Virus mosquitos are approaching the Lakeland area (apparently they move from west to east), so Lakeland is scheduled for air spraying within the next several weeks to control the type of mosquito that carries the West Nile Virus.

-If you have a mosquito, he urged residents to call 324-5547 and ask for an Inspector to review the problem. They frequently can find and eliminate the source.

8-1-1 is the number to call before you dig! Tennessee811 reminds residents that 8-1-1 should be called before any type of excavation. At least 72 hours notice must be provided, and the area to be excavated should be marked in white paint.

There is no charge for consumers calling 8-1-1 to check for buried utilities etc.

Construction on the Lakeland Senior Center and the parking lot for the IH Clubhouse and Lakeland Senior Center has started.

While the contract provides for the maintenance of parking during construction, parking will be very limited during construction and parking will be unavailable for short periods (for about 5-7 days while the base is being established) and for several days after the asphalt is laid.

As much advance notice as possible will be provided of closing dates. All visitors are reminded construction is in progress and extreme care should be utilized while parking and walking on the parking lot.

The First Baptist Church of Lakeland has graciously agreed to assist by providing parking for certain designated events and times. We appreciate the assistance!

Register now for Fall Soccer! Teams are available for children ages 4-11 years old. Practices begin Monday, August 22, for 4 & 5 year olds; Tuesday, August 23, for the 6-8 year olds; and Thursday, August 25, for the 9-11 year olds.

Lakeland Recreation Program Coordinator, Joy Cloud, emphasizes the importance of team size to give participants more opportunities to “touch the ball”. The 4-6 year olds play three on three, while 7-11 year olds play four on four. All practices and games are held at Lakeland City Hall Park.

Lakeland Sign Regulations especially relating to temporary political campaign signs are:

Signs on medians, intersections, or placed illegally on traffic control signs or public property (street right of ways, parks etc.) or, common open space, unoccupied property etc. are illegal signs and are picked up immediately. Common Open Space owned by the Home Owners Association etc. is not considered occupied property.

Political signs are allowed under the following circumstances:

-One sign per candidate or issue on an occupied lot. (with permission of the owner).

-Placed no closer than 15 feet to the edge of the pavement (or 5 feet behind the sidewalk), whichever is greater.

-Cannot be erected more than 30 days before Early Voting and must be removed within three days after the election.

-Signs cannot exceed 5 square feet in area per side and cannot exceed 48” in height.

ZIP + 4 provides Lakeland identity

While we are still actively attempting to secure a "unique" ZIP code for Lakeland, I was advised that if Lakeland residents use their "ZIP + 4" number this will identify a Lakeland as a "Lakeland" resident, and also may assist in assuring that sales tax revenues go to the right City and that your residence is identified as "Lakeland" for insurance, tax, labeling and other reasons. It may also help on GPS searches, depending on the GPS unit.

I am starting to use my "ZIP + 4" address on all correspondence for both my home and City Hall and will keep you advised of the results.

I am hoping using the ZIP + 4 address along with continuing to change my address to "Lakeland" whenever another City is used that I will eventually get all of my mail addressed to "Lakeland".

In the meanwhile, we will continue to petition the U.S. Postal Service for a unique "Lakeland" address.

To determine your unique "ZIP + 4" address, go to www.usps.com., click on "find a ZIP code" and you can find your unique ZIP Code.

For example, City Hall is 10001 Highway 70, Lakeland, Tennessee 38002-8068 and we will begin emphasizing this address and hopefully avoid the address of "Lakeland City Hall, Arlington, Tennessee!".

The Greater Memphis Chamber of Commerce recently sent out the following reminder to all area businesses, who may have had some impact by the flooding.

The U.S Small Business Administration is concerned about the low number of applications that have been returned for disaster recovery assistance from the recent floods and tornadoes. Out of 376 businesses that made contact with FEMA, only 29 have turned in an SBA application to receive low interest loan assistance @ 4% interest for physical damage and/or economic impact damage.

Please encourage any business that you know of that has been affected in any way by the recent floods to download an application from sba.gov. The deadline of June 30 is fast approaching.

P.S. Even businesses outside of Shelby County who did not sustain any physical damage are eligible for Economic Impact low-interest loans.

Girl Scouts complete "Rain Gardens" Project at City Hall

Under the direction of Staff Engineer Emily Boswell, Girl Scout Troop # 10125 worked hard on developing “rain gardens” for a beautification project at City Hall. The finished project is impressive and will be a welcome addition to City Hall!

Troop Leader Shelly Cheng reported that Girl Scouts working on their Junior Bronze Award who worked on the project included Megan Cheng, Emily Green, Marissa Crowell and Taryn Krier. Other Brownies and family members also assisted in the all day project.

A “rain garden” not only beautifies the area, but also helps with the drainage of the area and helps retain and treat stormwater runoff.

Our thanks to all who helped on this project!

Volunteers Make Lakeland Happen!

The Annual Arbor Day event, Spring Festival (Easter Egg Hunt) and Lakeland Clean-up Day emphasized the importance of volunteers and contributions by Lakeland organizations and businesses.

The Lakeland Lions Club and Trustmark Bank of Lakeland helped an estimated 130 children (and parents and other family members) enjoy the annual Spring Festival/Easter Egg Hunt and enjoy activities such as face painting, games and the actual Easter Egg Hunt. The Lakeland Lions Club contributed both funds and approximately 15! volunteers to the event and really helped make the event a success!

Members of the Lakeland Natural Resources volunteered in making the Arbor Day event a success, highlighted by the annual planting of a tree and especially by the tree climbers who amazed the crowd with their tree climbing skills as they pruned "dead wood" from a tree overhanging the playground equipment in City Hall Park. They also emphasized the role of safety in working with trees.

The Annual Lakeland Clean-up day was a success and assisted by All Star Waste Services and City personnel, including volunteer work City Engineer Philip Stuckert and his wife, Joyce.

Thanks to all of the volunteers and especially to the Lakeland Lions Club and Lakeland Trustmark Bank!

The next Lakeland event is the Annual Fishing Rodeo. Due to other events and a dramatic increase in the price of fish, we are especially in need of volunteers and funds this year to make this annual event a continued success! The second annual community wide clean up day will be held on April 16 from 9 a.m. until 2 p.m. at Windward Slopes Park on Beverlie Rivera Drive just east of the fire station. Those who participated in last year’s event will recall the severe thunderstorms which lasted throughout the day. In spite of the storm, over 3 tons of mixed trash, 1400 pounds of scrap metal and white goods, and 700 pounds of e-waste were collected. These quantities of discards were generated by an estimated 45 to 50 residents who took advantage of the opportunity to dispose of un -wanted items.

This year we are hoping for better weather and a larger turnout. We urge all city residents to take advantage of this opportunity to dispose of those hard to get rid of items you have been meaning to do something about.

Recycling and Refuse Report

A report by City Engineer Philip Stuckert provides the following insights into recycling and refuse:

-About 25% of Lakeland (950 of 3800 households) recycles on any given recycling pickup day.

-Lakeland's recycling totals for 2010 were 232.8 tons of paper and 160.3 tons of "commingled materials. In 2009, the totals were 232 .07 tons of paper and 149 tons of commingled material.

-Refused hauled to the landfill decreased from 4815 tons to 3824 tons, a 20.6% decrease. This was a result of diverting yard waste by segregating the majority of yard waste from municipal waste.

-Each Lakeland resident generated 2.0 pounds of refuse per day. The national average is 4.34 pounds per person per day.

Fines, felony charges, seizure of vehicles and damages will result from driving any motorized vehicle (ATV’s, motorcycles, and vehicles) off-road on City parks or public property. Diving motorized vehicles on private property is also illegal trespassing without the express permission of the property owner and property owners are encouraged to file complaints in court and seek damages.

Illegal vehicles also pose a threat of injury or death to walkers, runners and bicycle riders.

Due to recent heavy damage by vandals driving off road on wet city parks and both public and private property, the City has adopted a “zero tolerance” policy and will take action to collect on damages, file vandalism or trespassing charges as appropriate, and, if a felony will file to seize the vehicle doing the damage. The City is working with the Shelby County Sheriff in strictly enforcing laws against motorized vehicles trespassing on City parks, trails and public or private property.

The City also encourages private property owners to file charges when possible to discourage the trespassing and vandalism.

Residents are asked to report all trespassing to the City of Lakeland (867-2717) and the Shelby County Sheriff at 379-7625. While the Sheriff may not always be able to respond while the damage is in progress, reporting these will document the time and place of the incident.

Recent incidents of substantial vandalism by illegal trespassing by motorized vehicles have occurred in the Cool Springs area and IH Park area.

Residents are encouraged to report all incidents so the City and Shelby County Sheriff can develop patterns to apprehend persons who trespass and vandalize property.

Canada/I-40 Interchange construction scheduled for 2012

Senator Mark Norris recently advised Lakeland Mayor Scott Carmichael that the Tennessee Department of Transportation (TDOT) had advised him that construction on the I-40/Canada Road interchange is expected to start in 2012. This is approximately two years sooner than previously expected.

Both Senator Norris and Representative Ron Lollar have been instrumental in working with the City on this project. TDOT personnel have also been very effective in keeping the massive amount of paperwork moving that is necessary on a project like this.

Our appreciation to Senator Norris, Representative Lollar and TDOT personnel for their assistance in moving this project along.

Activation of signal lights at I-40 and Canada Road scheduled

Shelby County officials have advised the traffic signals at I-40 and Canada Road are scheduled to be inspected Tuesday, December 7.

The signal lights will “blink” for 7 days before being fully operational on or about December 14. The Tennessee Department of Transportation requires that signal lights “blink” for at least seven days before becoming operational.

What are the Cameras for at the I-40/Canada Road interchange?

Many residents have noticed the cameras at the I-40/Canada Road interchange. City Engineer Philip Stuckert explains the use of the cameras:

The I-40/Canada Road signals have overhead optical cameras that provide for vehicle detection. They cannot be used for red light violations. The purpose of each camera is to determine the presence of a vehicle in a driving lane. If the camera detects the presence of a vehicle, then information is sent to the signal controller box whereby the controller decides to service that lane with a green light for traffic movement. If no vehicle is detected, then the signal controller does not service that lane of traffic by turning the signals green. This allows the controller to give that “green time” to other legs of the intersection which has vehicles and needs that time to move more traffic through the intersection.

The cameras take the place of induction loops that are installed in the pavement. Induction loops are installed as vehicle detection devices because they are much cheaper than cameras. However in certain conditions such as bridge decks, induction loops cannot be cut into the pavement as they can be in asphalt pavements. Therefore cameras were installed at this signal location.

I saw an ad this morning where the organization that calls itself "Rebuild Government" apparently feels that if the lawsuit questioning the two separate votes is not constitutional, somehow the election will be valid. Hopefully, any court finding would require an entire new process. Of course, the organization that calls itself "Rebuild Government" started off saying it wasn't pro or anti Metro, it just wanted a "conversation" was actually raising over $500,000 to, in my opinion, support any Metro Charter. Hopefully any court decision will recognize that the election was held on the basis of two separate votes and, regardless of the court decision, this election will not be reversed.

Regardless, it is important that suburban voters VOTE. This Press Release was sent Sunday afternoon and is being reprinted for voter information.)

THE REALITIES OF CONSOLIDATION

Consolidation is the only path to create a leaner, less expensive and more responsive Metro organization replacing Memphis and Shelby County government, or so we are led to believe by promoters. Why? Efficiency, they say. Their job was to recommend ways to improve the effectiveness and efficiency of local government, the commission members write. They believe their recommendations will do that and, as a result, lower the cost of local government and, by implication, should reduce property taxes. Too bad it’s not true. Making such a statement shows a remarkable lack of familiarity with the real world of local government consolidation. Even the experts who research this area question the inevitability of improved efficiency.

For instance, Indianapolis is used as an example of vibrant growth and success resulting from consolidation. However, the publication Indiana Policy Review surveyed researchers with direct knowledge of the effects of local government consolidation in the fall of 2005. Ninety percent of those responding believed that consolidation would not reduce taxes. Only about half with direct knowledge of Indianapolis believed local UNIGOV had reduced overall costs while more than half believed it was harder for citizens to access government services after the consolidation, Mr. Sam Stanley, Ph D. testified before the Indiana legislature

The reasons for such results are complicated and reflect the practical difficulties of implementing consolidation. In many cases, the consolidation process simply negotiates up. That is, employees in local governments who are paid less are brought up to the pay scales of the best-paid government workers. Moreover, the transition costs of consolidation - renegotiating collective-bargaining agreements, developing and adopting common standards, restructuring and realigning public services - are routinely underestimated by the consolidation advocates. In fact, the most rigorous statistical studies of police and fire department consolidations find little or no impact on service levels, productivity or efficiencies.

As an incentive to suburban cities, the Commission included a provision in the charter to allow current annexation reserve areas to remain with the suburban cities, as provided in Tennessee Public Act 1101, allowing them to continue with their plans for future growth and development. This was against the finding of then County Attorney Brian Kuhn that annexation reserve areas would disappear under consolidation. Disregarding this advice, the commissioners sought a different opinion from a private law firm, Baker-Donnellson, which would be more to their liking and obtained it. The provision was subsequently included in the charter. Now comes the State Attorney General of Tennessee Robert Cooper Jr. who issued an opinion this week affirming the opinion of the County Attorney. So, growth and development plans of the suburban cities appear to be dead under the new charter.

This is only one example of the claimed benefits for consolidation not being well thought through. Advantages to the taxpayers of Memphis and Shelby County remain elusive or fuzzy. We asked the Charter Commission about many issues of concern to the voters throughout the past six months. There have never been clear facts and hard numbers given by them about:

Efficiencies Gained – We contend there are few, if any, duplications resulting in efficiencies. Simply stated, efficiencies go down in bigger organizations.
Organization Simplification – The new organization is an overlay of the two old ones with all the same functions and staff – just bigger. It will contain the same number of people.
Projected Tax Rates – Tax rates will go up significantly in the General District due to cost shifts, single source school funding and increased costs.
Cost Reductions – None have been demonstrated. We contend costs will go up.
Staff Reductions – All jobs are guaranteed at first by the charter and claimed reductions will be realized through attrition. There’s no political stomach for layoffs.
Salary & Benefit Leveling – Will level upwards to the highest values, increasing costs.
Service Delivery – Projected to go down due to inefficiencies of the larger government bureaucracy
Transition Costs – Very significant costs from merging systems and organizations are unidentified and no provisions for funding have been provided.

When asked about those things during the charter commission’s work, people were repeatedly told: “well, we’ll decrease work force by attrition”, or “that will be up to the transition commission or the new metro council”. The transition commission will be composed of people in city and county government who will be appointed to the position, not elected by you and I. The transition commission will create a plan that is recommended to the metro council. The council can amend it. Do you trust they will act in your best interests?

Advocates contend a metro government will offer a “one stop shop” for investors and developers, eliminating red tape and approvals by both Memphis and Shelby County. Despite not having consolidated government, most other urban communities are successful in attracting business and industry. They also have dual governments. They’ve figured out a way to make the process smooth and seamless without government merger. Importantly, companies that don’t choose Memphis look long and hard at other barriers to coming here: crime rate, work force deficiencies, education and property tax rates. They practically have to be bribed with PILOT tax incentives to come here, eroding the tax base. Those firms which locate to De Soto County don’t do so because of a consolidated government there. Either do those who re-locate from Memphis/Shelby County.

The frozen tax rate is a fallacy. Although the charter says the tax rate shall be capped for the first three years, it speaks of it as a single rate and doesn’t say when the three years begin. It’s actually composed of two rates: the general services tax and the urban services tax. When services that were previously paid wholly by Memphians are pushed over onto the general services district, the latter’s tax rate has to go up (while the urban services rate goes down). If the three years begin when Metro Government does, that’s not until year 2014. What happens to the tax rates between now and then is anybody’s guess.

The charter commission has agreed not to include consolidation of the two public school systems in its proposal for metro government. However, there is no prohibition for the new metro government, once established, or other interests to consider a merger of the Memphis City Schools and Shelby County Schools. In fact, metro government will establish the general services tax as the single-source funder to both systems with revenues split on an average daily attendance basis. Assuming metro picks up what Memphis has been contributing separately to MCS and adds in SCS’ share, the property tax rate would need to rise by at least 25%.

With a few exceptions, there aren’t many duplicated services. Cities and counties aren’t really tasked with the same responsibilities. Except for some urban-style services that Shelby County now provides in unincorporated areas, there are differences. Cities collect garbage, fix streets, police, respond to fire and medical emergencies, operate parks and recreation, provide public housing, handle community development and run libraries. Counties provide the justice system of courts and incarceration, local funding for education, the health department and the constitutional office functions. Any claimed cost reductions due to “duplicated services” are, in fact, minimal in the bigger picture, once the two are overlaid on each other.

Elections of the Mayor and Metro Council are nonpartisan under the new charter. Instant Run-Off Voting will apply when it can be implemented in the future using new software yet to be written, much less purchased. Given the difficulties, year after year, with the voting process in Shelby County, the confusion and the contentious arguments (sometimes well founded) of fraud and deception, its irrational to think that Shelby County voters are prepared for IRV. When it was promoted to the Charter Commission, it was clear that some (maybe many) of the commissioners were struggling to figure out how it works. It’s admirable to try to reduce election expenses by eliminating run-offs but not if the voters aren’t confident that their votes (for first, second, third, etc.) will be correctly counted. The two-party system in Memphis/Shelby County will effectively disappear for local elections.

Although a significant effort was made by the Charter Commission, the results are very disappointing. The opportunity for real change and reform has been missed. For many reasons, their product is one that practically nobody wants – the county and suburban mayors, the county and suburban legislative bodies, local unions, political and social groups, religious leaders and civic organizations all oppose it. What’s wrong with this picture and why did we go down this road? Consolidation is very risky at best, especially in today’s down economy. Once put in motion it can’t be reversed, leaving little room for error. It’s time to re-think the entire issue. Save Shelby County believes consolidation will not pass but serious reform in governance is desperately needed. That’s the reality.
